“In one of our cases a New York County jury returned a verdict of $13.2M for an injured construction worker who fell 4 feet from a crane on the 2nd Avenue Subway project. The construction worker hit his face and right shoulder on the street when he fell due to a missing step on the ladder of the crane. The Plaintiff suffered a torn ligament in his right shoulder that required surgery and post-concussion symptoms including short term memory loss and difficulty with his executive functioning. The legal team of Morgan Levine Dolan, P.C. and Fatos Dervishi have won a $4 million settlement from an insurance company for a union construction worker. The worker had suffered serious injuries to his foot, ankle, and knee. It was determined that the construction worker needed surgery and would not be able to return to construction work. The legal team pushed the insurance company right up to the trial deadline, at which point the insurance company relented and agreed to the settlement. Luckily the construction worker hired the right legal team to represent him. This gave him peace of mind to be able to provide for his wife and 14-month-old son for the rest of their lives.

Trip and Fall Accident – $3,295,582 verdict

The Dervishi Law Group obtained a $3,295,582 verdict against the New York City Transit Authority (NYCTA) on behalf of a 74-year-old Albanian janitor who slipped and fell down an outdoor subway stairway during a rainstorm at the Rockefeller Center subway station in Manhattan. Plaintiff, a Local 32BJ cleaner, was on his way to work at 1185 Sixth Avenue, when he slipped and fell on a step with a loose metal plate and a downward slope. The accident was not reported to the NYCTA. Nonetheless, based on his prior testimony, the NYCTA maintained that the Plaintiff, who testified through an Albanian interpreter, was not holding the handrail, stepped on something “soft” and was rushing to get to work. Although the radiology reports of his first three medical providers indicated that his cervical vertebrae fracture was “old” and “chronic,” his surgeon clarified that the clinical diagnosis and intra-operative findings demonstrated an acute injury. The jury awarded him $350,000 in past medical expenses, $240,000 in past lost earnings, $1,200,000 in past pain and suffering, $255,582 in future medical expenses, $250,000 in future lost earnings and $1,000,000 in future pain and suffering, with no comparative fault.

Construction Accident – $2.25 million settlement

The Dervishi Law Group secured a $2,250,000.00 settlement on behalf of a non-union laborer who sustained permanent injuries to his neck, back and knees at a Jamaica Avenue construction site in Queens. The worker was standing on a pile of castings on the back of a dump truck, rigging the top casting to four chains hanging from a front-end loader. With only three of the four chains rigged, the operator of the front-end loader lifted the bucket, striking the laborer and knocking him up off the truck and onto the sidewalk below. Although the operator of the front-end loader denied that he hit the laborer with the backhoe, claiming instead that the laborer had slipped from the side of the truck, after years of litigation and extensive negotiations, we were able negotiate this 2.25-million-dollar settlement on the laborer’s behalf, allowing him to provide some level of financial security for himself, his wife and his young children.

Trips and Fall Accident – $2,200,000 settlement

The Dervishi Law Group, and attorney Duane Morgan, represented a union carpenter who suffered a fall at work. This carpenter complained to his employer of neck and head pain, but he did not receive medical attention from a doctor. Instead, he continued working light (part time) duty for 7 months. This resulted in the employer laying him off from his job for missing so much work. This is when the union carpenter decided to seek legal counsel.

Almost 3 years after the original injury, the carpenter required neck surgery. Testimony from several doctors claimed his neck problems were degenerative issues. The Dervishi Law Group, along with attorney Duane Morgan, was able to prove differently. This resulted in the insurance company paying the carpenter for his lost wages, as well as pain and suffering in the amount of $2,200,000.

The Dervishi Law Group negotiated a $1,650,000.00 settlement on behalf of a 53-year-old, union bus driver who sustained an exacerbation of prior neck injuries when her bus was hit by a van making an illegal turn across five lanes of traffic. Our client received emergency room treatment two days after her accident, beginning a course of orthopedic care and pain management. With the help of her doctors, she was able to return to work eight months later, continuing to work another two years despite the ongoing pain, until she experienced a further exacerbation of her neck injury, necessitating surgery and permanently disabling her from employment. The settlement will provide this single mother with compensation for the pain and suffering caused by the defendant, as well as financial security as she faces ongoing medical expenses without employment.

Construction/Trip and Fall Accident – $1,525,000 settlement

The Dervishi Law Group secured a $1,525,000.00 settlement from the City of New York and another defendant for a laborer who sustained back injuries at a Bronx construction site on East 75th Street. The laborer, who was paid in cash, maintained that an un-shored trench in the roadway collapsed, causing him to fall approximately six to eight feet, sustaining his injuries. The general contractor at the site insisted that the trench did not collapse and testified that he had seen the laborer deliberately throw himself into the excavation. Despite the contractor’s somewhat astonishing allegations, after years of litigation, The Dervishi Law Group was able to negotiate over 1.5 million dollars in restitution for the worker.

Breaking News (Scaffold Accident) – 1.4-million-dollar settlement

“1.4-million-dollar settlement for a non-union scaffold worker who injured his head, neck, back, shoulder and both knees when a scaffold partially collapsed, leaving him dangling from a lanyard ten stories above.

A tower frame alongside a building on the Dumbo waterfront broke and swung outward, causing the scaffold worker to fall nearly ten feet over the edge, where he was found dangling from a lanyard approximately ten stories above the ground. Our investigation, including interviews with witnesses and our engineer’s subsequent inspection of the scaffold tower, revealed the couplers that secured the frames together failed, bending, breaking and causing the collapse.

The building owner and general contractor, who were responsible for furnishing safe and adequate scaffolding so as to give proper protection to the worker, were held responsible accordingly. This settlement will provide this then 37-year-old father of four with compensation for the pain, suffering and medical expenses caused by this incident, easing the financial burden he and his family has faced for the past three years.”

Although the plaintiff was not back to work at the time of the settlement, lost future earnings were heavily disputed by the defendants since the plaintiff had a good education and could do non-physical work.

This settlement holds the building owner, its commercial tenant, a general contractor and the worker’s employer responsible for failing to secure, shore, brace and inspect the ceiling throughout the hand-demolition operations; and will allow this once undocumented and disenfranchised father of five to provide the financial support his family has desperately needed since this incident took place.
